Consultation description
The Health (Miscellaneous Provisions) Act (Northern Ireland) 2016 granted the Department of Health powers to make regulations restricting the age of sale for e-cigarettes to persons over the age of 18. This legislation will bring these products into line with other age-restricted products such as tobacco and alcohol.
A regulation-making power prohibiting the proxy purchasing of e-cigarette products was also provided for in the above-named Act and this offence is included in the draft regulations.
The consultation process is seeking views on detail of the regulations, including proposed exemptions such as nicotine products which have been licensed as medicines suitable for use by under 18s, and licensed products available on prescription.
