The Mental Health (Northern Ireland) Order 1986 (‘the 1986 Order’) provides for the care and treatment of persons with a mental disorder in Northern Ireland.
The Coronavirus Act 2020 introduces temporary modifications to the 1986 Order in the event of an emergency. The emergency provisions in the Coronavirus Act were originally commenced in April 2020 and suspended in August 2020. The Coronavirus Act allows the provisions to be suspended and revived multiple times, and the provisions have now been revived with effect 18 January 2021.
The Department has made an updated Code of Practice for the latest temporary amendments to the 1986 Order which provides practical guidance on how they operate. Associated Emergency Forms for Health and Social Care Trusts have also been created.
